Why a Redistribution?

The Parliamentary Reform Act 1998, enacted in July, reduced the number of Legislative Council members from 19 to 15. This redistribution is to create the 15 new electoral divisions for the Legislative Council.

Redistribution Criteria

In accordance with the Legislative Council Electoral Boundaries Act 1995 the Committee's priorities, in order of importance, are:
a) to ensure that the number enrolled in each electoral division will not, in four and a half years time, vary more than plus or minus 10% from the average divisional enrolment; and
b) to take into account community interest by considering the following matters in the case of each electoral division: - communication and travel within the electoral division; - physical features and area of the electoral division; - existing electoral boundaries; - distinct natural boundaries.

The Redistribution Process

Step 1 Initial Redistribution Proposal The Committee will make and publish an initial redistribution proposal. Maps showing the names and boundaries of each proposed electoral division will be exhibited at each public office. Descriptions of the boundaries and reasons for the initial redistribution proposal, together with reasons for the disagreement (if any) of a member of the Committee, will also be available.
Step 2 28 Day Period For Public Comments, Suggestions & Objections Within 28 days after the publication of the initial redistribution proposal any person or organisation may lodge with the Redistribution Tribunal a written comment, suggestion or objection in relation to the initial redistribution.
Step 3 Redistribution Tribunal Inquiry The Redistribution Tribunal is to consider all comments, suggestions and objections lodged and give notice of its intention to hold an inquiry, its subject and the time and place at which it is to commence.
Step 4 Further Redistribution Proposal After the Tribunal has finished its inquiries a further redistribution proposal is made and published, together with the substance of the Tribunal's findings and conclusions. The Tribunal will state whether, in its opinion, its further redistribution proposal is significantly different from the initial proposal.
Step 5 7 Day Period For Further Comments, Suggestions and Objections If the Tribunal stated that, in its opinion, its further redistribution proposal is significantly different from the initial proposal, a person or organisation may lodge a further written comment, suggestion or objection with the Tribunal within 7 days.
Step 6 Redistribution Tribunal Inquiry The Tribunal must hold an inquiry into any further comment, suggestion or objection, and may have occasion to consider further objections at a later time before making a final determination. Steps 4, 5 and 6 may be repeated if the Tribunal states that, in its opinion, a further proposal is significantly different from the proposal preceding it.
Step 7 Final Determination of New Electoral Divisions The Tribunal will make a final determination of the names and boundaries of the 15 new Legislative Council electoral divisions.
Step 8 Tribunal Hearings into Transition Arrangements The Tribunal is to determine the transition arrangements to implement the redistribution of the State. The number of members of the Legislative Council is to be reduced from 19 to 15 by the third annual periodic election after the final determination of the new electoral boundaries. The Tribunal must conduct a hearing into matters relating to transition arrangements.
Step 9 Initial Transition Proposal As soon as practicable after its hearing the Tribunal is to make and publish its initial transition proposal.
Step 10 14 day Period For Comments, Suggestions or Objections A person or organisation may within 14 days after publication, lodge with the Redistribution Tribunal a written comment, suggestion or objection in relation to the initial transition proposal.
Step 11 Tribunal Inquiry into Transition Comments, Suggestions or Objections The Redistribution Tribunal must consider any comments, suggestions or objections received and may hold an inquiry into the matters raised in them.
Step 12 Final Transition Determination The Redistribution Tribunal is to make and publish a final transition determination as soon as practicable after the completion of its deliberations.
